These Terms of Service ("Terms") govern your access to and use of the Meals That Heal website, mobile applications, and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must discontinue use of our Services immediately.
1. Use License and Restrictions
We grant you a limited, non-exclusive, revocable license to access and use our Services for lawful purposes only. You agree not to:
- Use the Services for any illegal or unauthorized purpose
- Violate any laws or regulations applicable to the Services
- Infringe upon or violate the intellectual property rights or privacy of third parties
- Transmit viruses, malware, or any code of destructive nature

- Attempt to access unauthorized areas of our Services
- Reverse engineer, decompile, or attempt to discover the source code

- Content does not infringe third-party rights
- Content is not defamatory, obscene, or otherwise unlawful
4. Donations and Contributions
All donations to Meals That Heal are voluntary, non-refundable contributions. By making a donation:
- You authorize the charge to your payment method
- You represent that funds are legally obtained
- You consent to our use of the donation for food rescue and distribution
- You acknowledge that we are a tax-exempt nonprofit organization
- You may receive a receipt for tax purposes
5. Volunteer and Partner Agreements
Volunteers and partner organizations agree to:
- Comply with all applicable laws and regulations
- Follow food safety and handling guidelines
- Maintain confidentiality regarding donation sources and recipient information
- Act professionally and respectfully toward staff and the public
- Report any food safety concerns immediately
- Not misrepresent the mission or operations of Meals That Heal
6. Intellectual Property Rights
All content on our Services—including text, graphics, logos, images, software, and code—is the property of Meals That Heal or our content providers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, transmit, or otherwise use any content without our prior written permission.
7. Third-Party Links and Content
Our Services may contain links to third-party websites and content. We do not endorse, warrant, or assume responsibility for such third-party materials. Your use of third-party services is governed by their terms and privacy policies. We are not liable for any damages or losses arising from your use of third-party content or services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We provide our Services "as is" without warranties of any kind
- We disclaim all express and implied warranties, including merchantability and fitness
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability shall not exceed $100 or the amount you paid us, whichever is less
9. Indemnification
You agree to indemnify and hold harmless Meals That Heal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Services, your violation of these Terms, or your infringement of third-party rights.
10. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Sections regarding intellectual property, limitation of liability, and indemnification shall survive termination.
11. Dispute Resolution
Any disputes arising from these Terms or your use of our Services shall be resolved through:
- Good faith negotiation between the parties
- Binding arbitration under the American Arbitration Association rules
- Arbitration shall take place in Penobscot County, Maine
- Each party shall bear its own costs
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Maine, without regard to conflicts of law principles. You consent to the exclusive jurisdiction of the courts in Penobscot County, Maine.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of the Services following any modifications constitutes your acceptance of the revised Terms. We encourage you to review this page periodically for updates.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if impossible, severed. The remaining provisions shall continue in full force and effect.
